Terms & Conditions

These Terms & Conditions ("Terms") are between you and Emily Nelson ("the seller", "we", "us"), the operator of the game Archie's Paintball Target Score ("the service"). By accessing or using the service, you agree to these Terms. If you do not agree, please do not use the service.

1. The service

Archie's Paintball Target Score is a free browser-based target shooter game. Optional paid content — such as the "Neon Night" level — is offered as a one-time digital purchase that unlocks additional in-game content on your account.

2. Eligibility and accounts

You must be of legal age in your jurisdiction, or have a parent or guardian's permission, to use the service. If you create an account, you must provide accurate information, keep your credentials confidential, and you are responsible for all activity under your account. Usernames must be unique and must not impersonate another person or contain offensive or unlawful content; we may change or remove usernames that break this rule.

3. Acceptable use

You must not misuse the service. In particular, you must not:

• Use the service for anything unlawful, fraudulent, or deceptive, including spam.
• Infringe anyone's intellectual property rights.
• Interfere with the service's security or operation, including introducing malware, probing or scanning for vulnerabilities, or scraping the service at disruptive volumes.
• Attempt to gain unauthorized access to other accounts, manipulate scores, or exploit the leaderboard.
• Reverse engineer, resell, redistribute, or circumvent technical limits of the service.

4. Intellectual property

We retain all ownership of the service and its intellectual property, including the game software, artwork (including the Archie character), audio, documentation, and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the service for personal, non-commercial entertainment, within the plan or content you have access to.

5. Purchases, payments, and Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, which apply to your purchase in addition to these Terms. Digital content is delivered by unlocking it on your account once your purchase completes.

6. Service level

The service is provided "as is" and "as available". We do not guarantee uninterrupted, timely, or error-free performance, and we may modify, suspend, or discontinue parts of the service at any time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages (including loss of profits, data, or goodwill) arising from your use of the service. Our total aggregate liability to you is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is not permitted by law.

8. Suspension and termination

We may suspend or terminate your access to the service if you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate these rules. On termination, your right to use the service ends; we may delete account data after a reasonable period, except where we must retain it by law.

9. General

These Terms are governed by the laws of the seller's jurisdiction of residence, without regard to conflict-of-law rules. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. If any part of these Terms is found unenforceable, the rest remains in effect.
